• Frag-Maria, Obere Spichermatt, 6370 Stans, Switzerland (Email: maria@frag-maria.ai) for the AI service “Frag-Maria” (chat, telephony/voicebot, digital avatar), powered by Salesbroker GmbH (technical enablement services as a data processor/sub-processor).
To the extent that Salesbroker provides services on behalf of Frag-Maria, Salesbroker processes personal data as a (sub)processor in accordance with documented instructions. Salesbroker GmbH remains the controller for its own websites and offerings.
This statement applies to our websites, contact and ordering processes, support interactions, and the use of Frag-Maria.
The Privacy Policy of Salesbroker GmbH. This Privacy Policy specifies the data processing for the Shopify-based Frag-Maria website.

4.1 Subscriptions and Subscription Management via Subi
We use the Subi service to manage subscriptions. Subi is used to technically map recurring orders, subscription models, terms, payment intervals, and the management of existing subscriptions.
When you take out or manage a subscription, the following data in particular may be processed: name, email address, phone number, billing and shipping address, order and contract details, subscription status, payment and interval information, as well as technical data such as IP address, browser, and device information.
Subscription management can be carried out via an externally hosted Subi customer portal. Access is granted via the email address provided at the time of purchase or during management. In doing so, the data necessary for the provision and management of the subscription is transmitted to Subi.
Processing is carried out for the purpose of fulfilling the contract, managing the subscription, processing recurring services, and providing the technical infrastructure for subscription functions. The legal basis, where applicable, is Art. 6(1)(b) GDPR. To the extent that technical security and operational data are processed, this is additionally based on our legitimate interest in secure and reliable operation pursuant to Art. 6(1)(f) GDPR.

5. Legal Bases
To the extent that the GDPR applies, processing is based on:

- under Article 6(1)(f) of the GDPR based on our legitimate interest in efficient communication, secure operation, analysis, optimization, and the use of modern technologies

5a Data processing on behalf of B2B customers (Art. 28 GDPR)
If you use our services as a business and personal data of your customers, prospects, or users is processed via the Frag-Maria platform, we are your data processor within the meaning of Art. 28 GDPR.
In this relationship, Salesbroker GmbH / Frag-Maria™ acts as the contractor (data processor), and you as the client (data controller) . The basis for this processing is the Data Processing Agreement (DPA), which becomes legally effective upon the conclusion of your subscription and is an integral part of the General Terms and Conditions as well as the order confirmation.
The DPA specifically governs the subject matter and purpose of the processing, the categories of data processed, the subcontractors used, and the technical and organizational measures (TOMs). It will be sent to you along with the order confirmation and can be requested at any time at maria@frag-maria.ai.
6. Contacting Us
If you contact us via email, phone, or form, we process your information to handle your inquiry and for follow-up questions. The data remains with us until the purpose no longer applies, you request deletion, or legal retention obligations prevent it.
7. Calendly
We use Calendly for scheduling appointments. The data you enter is processed for appointment scheduling and communication.
8. Use of AI on the Website
We use AI-powered services and applications on our website. When you interact with these features, your inputs—including metadata—are processed to generate appropriate responses or reactions.
This is done on the basis of Art. 6(1)(f) of the GDPR. If necessary, processing is based on your consent in accordance with Art. 6(1)(a) of the GDPR.

We use AI-powered software to process and respond to customer inquiries. The AI analyzes the content of your message to generate appropriate responses or response suggestions autonomously or semi-autonomously. In particular, names, email addresses, communication content, and technical information may be processed.

We use chatbots to communicate with you. In addition to your inputs, other data may also be processed, such as contact information, chat histories, IP address, log data, location information, and other metadata.
The collected data may also be used to improve the chatbots and their response behavior. Where necessary, processing is based on consent.
